TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions of Service ("Terms") govern all services provided by Posh Auto Detailing ("Posh," "we," "us," "our"), a mobile vehicle detailing business based in Stanwood, Washington. Please read them carefully. They include limitations of liability, a damage claim procedure with deadlines, and other provisions that affect your legal rights.

1. AGREEMENT TO THESE TERMS

1.1 Parties. These Terms are a binding agreement between Posh and the person or entity purchasing services ("Customer," "you," "your").

1.2 Acceptance. You accept these Terms by any of the following: checking a box or clicking a button indicating acceptance during online booking; scheduling, confirming, or accepting Services through any channel, including by telephone, text message, or email; or permitting Services to begin. If you book on behalf of another person or a business, you represent that you have authority to bind that person or business.

1.3 Eligibility and Authority. You represent that you are at least 18 years of age and that you own the Vehicle or are authorized by its owner to obtain Services for it.

1.4 Definitions. "Vehicle" means any automobile, truck, van, recreational vehicle, trailer, boat, or other watercraft presented for Services. "Services" means the detailing and related services described at booking or in a quote or invoice.

1.5 Electronic Transactions. Electronic acceptance and electronic records are valid and enforceable under the Washington Uniform Electronic Transactions Act, chapter 1.80 RCW, and the federal E-SIGN Act.

2. SCOPE AND NATURE OF SERVICES

2.1 What We Do. Posh provides mobile cleaning and protection services, including interior and exterior detailing, washing, decontamination, one-step polishing where included in the booked service, and application of sealants, waxes, and coatings.

2.2 What We Do Not Do. Posh does not perform paint repair, bodywork, dent or scratch repair, multi-stage paint correction beyond any one-step polish included in the booked service, upholstery or trim repair, or mechanical, structural, or electrical repair.

2.3 Cleaning Is Not Restoration. Detailing is a cleaning and protection process. Results depend on the age, materials, history, and condition of the Vehicle. Posh does not guarantee removal of any particular stain, odor, scratch, swirl, water spot, oxidation, or other defect.

2.4 Estimates. Service descriptions, durations, and arrival windows are good-faith estimates and may vary with Vehicle size and condition.

3. QUOTES, PRICING, AND CONDITION-BASED CHARGES

3.1 Starting Prices. Published prices are starting prices based on vehicles of average size and condition. Final pricing may be adjusted after in-person inspection.

3.2 Condition-Based Charges. Additional charges may apply for conditions requiring extra time, labor, or materials, including without limitation excessive pet hair, pine needles, sand, tree sap, heavy soiling, mold or mildew, bodily fluids or other biohazards, and vehicles not cleared of personal items. Such charges will be identified at inspection or, if discovered during Services, communicated to you before the additional work is performed.

3.3 Travel Fees. Travel fees apply per the schedule published or quoted at booking.

3.4 Taxes. Prices do not include sales tax. Washington destination-based sales tax is added at the rate applicable to the service location.

3.5 Quote Validity. Quotes are valid for 14 days unless otherwise stated.

4. SCHEDULING, SITE ACCESS, AND WEATHER

4.1 Workspace. You must provide a lawful, safe, reasonably level workspace with adequate clearance around the Vehicle at the agreed service location.

4.2 Authority at the Location. You represent that you have the right and any required permission for Services to be performed at the service location, including under any applicable homeowners association, landlord, workplace, marina, storage facility, or similar rules. You are responsible for compliance with those rules and for any site fees.

4.3 Utilities. Posh generally operates self-contained with its own water and power. If use of on-site utilities is agreed, you will provide safe and adequate access.

4.4 Weather and Safety. Exterior Services may be rescheduled due to rain, wind, temperature extremes, or unsafe conditions, at no charge to either party. If you elect to proceed in marginal conditions after being advised of the risk, results affected by weather, such as water spotting, are not grounds for a claim.

5. CANCELLATIONS, RESCHEDULING, AND MISSED APPOINTMENTS

5.1 Notice. You may cancel or reschedule at no charge with at least 24 hours of notice.

5.2 Late Cancellation Fee. A $50 fee applies to cancellations made with less than 24 hours of notice and to appointments where the technician arrives and cannot reasonably access the Vehicle or the service location. The parties agree this fee is a reasonable estimate of the scheduling and travel costs of a late cancellation, and constitutes liquidated damages rather than a penalty.

5.3 Rescheduling by Posh. Posh may reschedule for weather, safety, illness, or equipment failure. In that event Posh's sole obligation is to perform the Services at the earliest mutually available time, and no fee applies to you.

6. VEHICLE CONDITION, PRE-EXISTING DAMAGE, AND DISCLOSURE

6.1 Pre-Service Documentation. The technician will note visible pre-existing damage before beginning work and may photograph the Vehicle before, during, and after Services to document its condition.

6.2 Your Duty to Disclose. You must disclose, before Services begin, any known conditions of the Vehicle, including without limitation mold or mildew, bodily fluids, needles or other sharps, pest infestation, water leaks, non-functioning components, loose or fragile trim, aftermarket films, wraps, tint, or accessories, and prior repainting or repairs. Posh is not responsible for issues arising from conditions you knew of and did not disclose.

6.3 Cleaning Reveals, It Does Not Cause. The removal of dirt, grime, wax, or films can expose pre-existing conditions that were previously hidden, including clear coat failure, thinning or peeling paint, oxidation, scratches, swirl marks, water etching, faded trim, overspray, and prior substandard repairs.

POSH IS NOT RESPONSIBLE FOR PRE-EXISTING CONDITIONS THAT BECOME VISIBLE AS A RESULT OF NORMAL CLEANING.

6.4 Aged and Fragile Components. Vehicles and vessels age. Normal, industry-standard cleaning of aged, worn, brittle, sun-damaged, corroded, loose, or previously repaired components is performed at your risk. Examples include exterior trim, moldings, and emblems; headliners; aged or cracked leather, vinyl, and plastics; peeling films or tint; aftermarket accessories and adhesives; deteriorated seals, gaskets, and weatherstripping; and deteriorated RV roof and seam sealants. Posh is not liable for the failure of such components under normal cleaning processes.

6.5 Water Use. Services involve water, steam, and cleaning solutions applied using standard industry methods. Posh is not responsible for water intrusion caused by defective or deteriorated seals, gaskets, drains, or prior damage.

7. CHILD SAFETY SEATS

7.1 For safety and liability reasons, technicians do not remove, disassemble, or reinstall child safety seats or their bases.

7.2 If you want the area beneath or around a child safety seat cleaned, you must remove the seat before the appointment and reinstall it afterward. Correct reinstallation is solely your responsibility.

8. PERSONAL PROPERTY, VALUABLES, AND HAZARDOUS ITEMS

8.1 Remove Valuables. Remove money, jewelry, electronics, documents, and other valuables and personal items before Services. Posh is not responsible for loss of or damage to items left in the Vehicle, except to the extent caused by Posh's gross negligence or willful misconduct.

8.2 Found Items. Items found during Services are set aside and returned to you.

8.3 Weapons and Hazardous Items. Technicians will not handle firearms, other weapons, hazardous materials, or apparent contraband. If such an item is encountered, work in the affected area will stop until you secure or remove the item, and Posh may discontinue Services under Section 12.

8.4 Keys. Keys are handled with care and returned at completion. If you will not be present, key exchange and storage follow your instructions and are at your risk.

9. PAYMENT

9.1 When Due. Payment is due in full upon completion of Services unless invoice terms are agreed in writing, such as for fleet accounts.

9.2 Methods and Failed Payments. Accepted payment methods are stated at booking or on the invoice. Returned or failed payments are subject to a handling fee and recovery of bank charges as permitted by Washington law.

9.3 Past-Due Balances. Invoiced balances not paid when due accrue interest at 1 percent per month (12 percent per annum) or the maximum rate permitted by law, whichever is less, plus reasonable costs of collection.

9.4 Reservation of Rights. Posh reserves all rights and remedies available under applicable law with respect to unpaid charges for Services performed, including any available lien rights.

10. INSPECTION, SATISFACTION, AND DAMAGE CLAIMS

10.1 Inspect at Completion. You or your representative should inspect the Vehicle before the technician leaves the service location.

10.2 Workmanship Concerns and Re-Performance. If you are not satisfied with an area of the work, notify Posh before the technician leaves or in writing within 24 hours of completion. Posh will re-perform the affected portion of the Services at no charge at the earliest mutually available time. Re-performance is your exclusive remedy for workmanship concerns, and completed Services are otherwise non-refundable except where a refund is required by law.

10.3 Damage Claims. If you believe Posh damaged the Vehicle or other property, you must notify Posh in writing, by email or text message, within 48 hours of completion, including photographs of the claimed damage. Time matters because vehicles continue to be driven, washed, and exposed to the elements after service.

10.4 Right to Inspect. Posh has the right to inspect the claimed damage in person before any repair is performed.

10.5 Resolution. If Posh determines it is responsible, Posh may, at its option, repair the damage through a vendor of its choosing or compensate you subject to Section 14. Posh is not obligated to reimburse third-party repairs performed without its prior written authorization.

10.6 Waiver of Late Claims. To the extent permitted by law, claims not presented in accordance with this Section 10 are waived.

11. SERVICE-SPECIFIC TERMS

11.1 Odors and Stains. Odor treatment reduces odors but cannot guarantee elimination of odors embedded in HVAC systems, foam, carpet padding, or headliners, particularly smoke, pet, and mildew odors. Some stains are permanent and cannot be fully removed.

11.2 Ceramic Coatings. Coating performance depends on surface preparation, environment, and your maintenance. Coatings resist, but do not prevent, rock chips, scratches, scuffs, water spotting, and environmental fallout. You must follow the cure-care instructions provided at delivery, including any initial no-wash period. Durability figures are manufacturer estimates under proper maintenance, not a warranty of a specific lifespan by Posh.

11.3 RV Services. A roof photo or condition disclosure may be required before booking. Heavy roof moss, lichen, or grime may carry condition-based charges under Section 3.2. You are responsible for maintaining roof and seam sealants. Posh is not responsible for pre-existing leaks or for the condition of deteriorated lap sealant or seals around roof fixtures. Oxidation on aged gelcoat or fiberglass may not fully resolve within the booked service tier.

11.4 Marine Services. You are responsible for arranging and paying for moorage, haul-out, lift, or yard access and for confirming that the marina or yard permits the work. Posh may decline a service tier that is unsuited to the vessel's condition and recommend the appropriate tier. Results on heavily oxidized gelcoat and on nonskid surfaces vary with condition.

11.5 Fleet Accounts. If a separate written fleet agreement exists between Posh and the Customer, that agreement controls over these Terms to the extent of any conflict.

12. RIGHT TO REFUSE, PAUSE, OR DISCONTINUE SERVICE

12.1 Posh may refuse, pause, or discontinue Services if the Vehicle's condition was materially misrepresented; if biohazards, infestation, or unsafe conditions are present; if site access is unsafe or unauthorized; or if a customer engages in abusive, threatening, or unlawful conduct.

12.2 If Services are discontinued mid-job for a reason described in this Section, you will pay a fair prorated amount for work performed and materials used.

13. PHOTOGRAPHS, MARKETING, AND COMMUNICATIONS

13.1 Photographs. Posh may photograph the Vehicle before, during, and after Services for documentation, and may use photographs and video in its portfolio and marketing. License plates will be obscured on request, and your name and address will not be published without your consent. You may opt out of marketing use at any time by written notice.

13.2 Service Communications. By providing your contact information, you agree to receive service-related communications, such as confirmations, reminders, arrival updates, and receipts, by text message, email, or phone. Message and data rates may apply. Reply STOP to end text messages. Marketing messages are sent only with your consent.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) POSH'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO ANY SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THAT SERVICE; (B) POSH IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE, RENTAL COSTS, TOWING, DIMINISHED VALUE, OR LOST PROFITS; AND (C) POSH IS NOT LIABLE FOR PRE-EXISTING CONDITIONS, LATENT DEFECTS, AGED OR DETERIORATED MATERIALS, AFTERMARKET PARTS, FILMS, ACCESSORIES, OR ELECTRONICS, OR PRIOR SUBSTANDARD REPAIRS, INCLUDING WHERE SUCH CONDITIONS BECOME VISIBLE IN THE COURSE OF NORMAL CLEANING.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER WASHINGTON LAW.

15. DISCLAIMER OF WARRANTIES

15.1 Posh will perform Services in a professional and workmanlike manner consistent with industry standards.

15.2 EXCEPT AS EXPRESSLY STATED IN THESE TERMS, SERVICES ARE PROVIDED WITHOUT ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW. POSH DOES NOT WARRANT ANY SPECIFIC COSMETIC OUTCOME.

16. INDEMNIFICATION

You will defend, indemnify, and hold harmless Posh and its owner, employees, and contractors from and against third-party claims, damages, losses, and reasonable costs, including attorney fees, arising out of (a) your breach of these Terms or misrepresentation of the Vehicle's condition; (b) undisclosed hazardous or biohazardous conditions; (c) the service location, including lack of authority or unsafe site conditions; or (d) items left in the Vehicle. This Section does not apply to the extent a claim results from Posh's gross negligence or willful misconduct.

17. DISPUTE RESOLUTION, GOVERNING LAW, AND VENUE

17.1 Talk First. Before filing any claim, the party asserting it will give the other party written notice describing the dispute, and the parties will attempt in good faith to resolve it within 30 days.

17.2 Governing Law. These Terms and any dispute arising out of them are governed by the laws of the State of Washington, without regard to conflict-of-laws rules.

17.3 Venue. Any suit must be brought in the state courts located in Snohomish County, Washington, and each party consents to jurisdiction and venue there. Either party may bring a qualifying claim in small claims court, which is encouraged for disputes within its limits.

17.4 Attorney Fees. In any action to enforce these Terms, the prevailing party is entitled to recover its reasonable attorney fees and costs to the extent permitted by law.

17.5 Time Limit on Claims. To the extent permitted by law, any claim arising out of Services must be commenced within one year after the date the Services were performed, or it is permanently barred.

17.6 Individual Claims. To the extent permitted by law, disputes will be resolved on an individual basis, and neither party will participate in a class or representative action against the other.

18. GENERAL PROVISIONS

18.1 Entire Agreement. These Terms, together with the applicable booking confirmation, quote, or invoice, are the entire agreement between the parties regarding the Services and supersede prior discussions. A signed written agreement, such as a fleet agreement, controls over these Terms to the extent of any conflict.

18.2 Severability. If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, if it cannot be, severed, and the remainder of these Terms will remain in full effect.

18.3 No Waiver. A failure to enforce a provision is not a waiver of it. Waivers must be in writing.

18.4 Assignment. You may not assign these Terms without Posh's written consent. Posh may assign them in connection with a sale or reorganization of the business.

18.5 Force Majeure. Posh is not liable for delay or failure to perform caused by events beyond its reasonable control, including severe weather, road closures, supplier failures, illness, and utility outages.

18.6 Updates to These Terms. Posh may update these Terms from time to time. The version posted on Posh's website at the time you book governs that booking, and material changes are indicated by a new Effective Date and Version number.

18.7 Survival. Sections 6, 8, 9, 10, and 14 through 18 survive completion of the Services.

18.8 Headings. Headings are for convenience only and do not affect interpretation.
